The Consumer Protection Act 2019 brought significant new protections for consumers in India including e-commerce regulation, product liability, and higher pecuniary limits.

Consumer Rights Under Consumer Protection Act 2019

The Consumer Protection Act 2019 replaced the old Consumer Protection Act 1986 and brought sweeping changes to consumer rights in India.

Major Changes in the Act

E-Commerce Regulation: Online purchases from platforms like Amazon, Flipkart, and others are now clearly covered under the Act. Consumers can file complaints against both the seller and the e-commerce platform.

Product Liability: Manufacturers, sellers, and service providers can be held liable for damages caused by defective products even without proof of negligence.

Revised Pecuniary Jurisdiction:

  • District Consumer Forum: Up to Rs.1 Crore
  • State Commission: Rs.1 Crore to Rs.10 Crore
  • National Commission (NCDRC): Above Rs.10 Crore

How to File a Consumer Complaint in Kerala

  1. Gather all evidence: purchase receipts, communications, photos of defects
  2. Send a legal notice to the seller/service provider
  3. File a complaint before the appropriate Consumer Forum
  4. Pay the nominal filing fee
  5. Attend hearings or have a lawyer represent you
